The Sixth Circuit Adult Drug Court is a diversion program that provides for the supervision and treatment of non-violent offenders who are chemically dependent. The program offers participants a chance to take control of their lives, end the cycle of drug abuse, crime, and incarceration.
Participants learn how to live sober, responsible, and satisfyingly productive lives. Adult Drug Court benefits society by reducing criminal activity, rehabilitating repeat criminal offenders, offering a cost efficient alternative to incarceration and enabling defendants to become productive citizens.
Procedure:
Application- A defendant is referred and an appointment for application is made to apply. The offender will bring picture ID and social security card.
Investigation- The ADC staff will contact all parties involved in the case for recommendations and run a SLED report. Defendant will be assessed for addiction by a certified addictions counselor.
Approval- Once approved, the defendant will plead guilty to the charges and the sentences will be deferred pending the successful completion of the program.
Participation- The offender will meet stringent counseling obligations and attend court on a weekly basis. A participation fee of $20 per week is paid by each client which can be waived by the Judge.
Completion- Upon successful completion of all program requirements, the charges will be dismissed and eligible for expungement.
Reminders:
All potential applicants must be referred by an attorney, public defender, probation officer or prosecutor before an application will be scheduled .
All money paid to Drug Court must be in form of a money order.
Offenders are only eligible to participate in ADC one time.
ADC is a comprehensive treatment program for non-violent offenders.
DUI offenses are ineligible for ADC.
Eligibility:
A defendant is eligible to apply for Adult Drug Court if he/she meets the following criteria:
The offender is over the age of 17 and has not previously participated in a Drug Court program in South Carolina.
The offender has not been charged with (nor has been convicted of) sexual offenses, trafficking, or crimes of violence such as: armed robbery, murder, or kidnapping.
The offender is referred to apply by an attorney, public defender, probation officer, or solicitor.
The offender can be diagnosed as addicted to drugs and/or alcohol by a certified addictions counselor.
Defendant must be a resident of the Sixth Circuit and have reliable transportation.
The defendant must plea guilty to the charges as agreed upon by the Solicitor and the Defense Attorney.
The defendant must have the cognitive ability to understand basic concepts and must not be suffering from any condition that could prevent or restrict the person’s active participation in the program.
This is a voluntary program. The participant must agree to the terms and conditions of participation as described in the Basic Understanding, Waivers, and Agreements consent form and the Participant Notebook.
The defendant must be referred before the bond returnable date (90 days after being arrested).
